Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the services provided by One Dash Zero LLC (“we,” “us,” or “our”), including our AI voice and chat agents, the FONE mobile application, client portal, management dashboards, APIs, and related products (collectively, the “Services”). By creating an account, downloading the FONE app, or otherwise using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 18 years old to use the Services. The Services are intended for business use and are not directed at consumers under the age of 18. By agreeing to these Terms, you represent and warrant that you are at least 18 years old and have the legal authority to enter into this agreement on behalf of yourself or the organization you represent.

2. Description of Services

One Dash Zero provides an AI-powered communications platform that includes:

AI Receptionist & Personal Agents — AI voice and chat agents that answer calls, respond to messages, schedule appointments, transfer calls, and take messages on behalf of your business
FONE App — A mobile and web application for managing your AI agents, making and receiving VoIP calls, and monitoring conversations in real time
Chat Widgets — Embeddable web chat, WhatsApp, Facebook Messenger, and Instagram DM integrations
Client Portal — A dashboard for business owners and managers to configure agents, view analytics, and manage team members
Integrations — Connections to third-party services including calendars, CRMs, e-commerce platforms, and notification tools

The specific features available to you depend on your subscription plan.

3. Account Registration and Security

To use the Services, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at dash@1-0.dev if you become aware of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that we reasonably believe are being used in violation of these Terms or that pose a security risk.

4. FONE Mobile Application

The FONE app is available for iOS and as a web application. By downloading and using the FONE app, you also agree to the terms of the platform through which you obtained it (e.g., Apple App Store Terms of Service, Google Play Terms of Service).

Device permissions: The FONE app requires access to certain device features to function properly:

Microphone — Required for VoIP calling. Audio is transmitted in real time during active calls and is not stored on your device.
Push notifications — Required to receive incoming call alerts, even when the app is in the background or closed. The app uses VoIP push notifications on iOS via Apple PushKit.
Network access — Required for VoIP calling, real-time messaging, and data synchronization.

You may disable permissions through your device settings, but doing so may prevent certain features from functioning.

VoIP calling: The FONE app uses Voice over Internet Protocol (VoIP) technology provided by Twilio. Call quality depends on your internet connection. VoIP calls made through the FONE app are not a replacement for traditional telephone service and cannot be used to make emergency calls (911/112).

5. AI-Generated Content

The Services use artificial intelligence to generate voice responses, chat messages, appointment summaries, and other content. You acknowledge and agree that:

• AI-generated outputs may contain errors, inaccuracies, or inappropriate responses
• You are responsible for reviewing and overseeing your AI agent’s interactions with your customers and callers
• We do not guarantee the accuracy, completeness, or suitability of any AI-generated content
• You are responsible for configuring your AI agent with accurate business information, operating hours, and instructions
• AI agents should not be relied upon for medical, legal, financial, or emergency advice

You retain responsibility for your business’s interactions with its customers, even when those interactions are handled by an AI agent configured through our Services.

6. Telephony, Recording, and Compliance

You are responsible for complying with all applicable federal, state, and local laws regarding telephone communications, including:

Call recording consent: Many jurisdictions require one-party or all-party consent before recording a call. You are solely responsible for ensuring your AI agent’s recording practices comply with the laws of your jurisdiction and the jurisdiction of your callers.
Telephone Consumer Protection Act (TCPA): You may not use the Services for unsolicited telemarketing, robocalls, or automated dialing to numbers on the Do Not Call Registry.
No emergency services: The Services do not support emergency calls (911/112). Do not rely on the Services as your sole means of communication.
Caller ID and spoofing: You may not use the Services to transmit misleading or fraudulent caller ID information.

You may not use the Services for illegal robocalls, spam, harassment, fraud, impersonation, or any unlawful purpose.

7. Third-Party Integrations

The Services allow you to connect third-party services such as Google Calendar, Slack, Microsoft Teams, Square, Shopify, HubSpot, and others. When you enable an integration:

• You authorize us to access and transmit data between the Services and the third-party service as necessary to perform the integration
• You are responsible for complying with the third-party service’s terms of service and privacy policies
• We store the API credentials and access tokens you provide, encrypted at rest
• We are not responsible for the availability, accuracy, or security of third-party services
• You may disconnect an integration at any time through the FONE app, which will stop data exchange and delete stored credentials for that integration

8. Your Content and Data

You retain ownership of the content and data you provide to the Services, including business descriptions, agent configurations, and customer data. By using the Services, you grant us a limited license to use, process, store, and transmit your content solely to provide and improve the Services.

You represent that you have the right to provide any content you upload or configure, and that your content does not violate any third party’s rights or any applicable law.

Call recordings and transcripts generated through the Services are owned by you (the customer whose AI agent handled the call). We process and store this data on your behalf and provide it to you through the Services.

9. Acceptable Use

You agree not to:

• Use the Services for any illegal, harmful, or fraudulent purpose
• Interfere with or disrupt the Services or the servers and networks connected to them
• Attempt unauthorized access to any part of the Services or other users’ accounts
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of any part of the Services
• Use the Services to transmit malware, viruses, or other malicious code
• Use the Services to harass, threaten, defame, or harm any person
• Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity
• Use the Services to collect personal information about others without their consent
• Resell, sublicense, or redistribute the Services without our written consent (except as permitted under an authorized reseller agreement)
• Use the Services in a manner that could damage, disable, or impair the Services

We reserve the right to suspend or terminate your access to the Services for violation of these acceptable use provisions.

10. Intellectual Property

One Dash Zero LLC owns all rights, title, and interest in and to the Services, including all software, algorithms, AI models (as configured by us), user interfaces, designs, trademarks, service marks, logos, and other intellectual property. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Services in accordance with these Terms and your subscription plan.

You may not use our trademarks, logos, or brand assets without our prior written consent. “One Dash Zero,” “1-0.dev,” “FONE,” and “Dash” are trademarks of One Dash Zero LLC.

11. Billing and Payments

Subscriptions are billed monthly in advance and auto-renew on the same day each month. You authorize us to charge your payment method on file for all applicable fees.

• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused time within a billing period.
• Implementation and setup fees are non-refundable once work has begun.
• All fees are exclusive of applicable taxes, which will be added where required by law.
• Additional charges may apply for telephony usage, carrier surcharges, and pass-through costs. These are billed in arrears based on actual usage.
• If a payment fails, we will attempt to charge your payment method again. If payment remains unsuccessful after reasonable attempts, we may suspend your Services until payment is received.

12. Pricing

Current pricing as of the effective date of these Terms:

AI Receptionist Plans:
• Launch: $850 implementation + $299/month
• Professional: $3,500 implementation + $700/month
• Scale: $7,500 implementation + $1,250/month
• Enterprise: Starting at $25,000 implementation + $5,000+/month

AI Personal Agent: $399 implementation + $149/month

Pricing is subject to change. We will provide at least 30 days’ notice before any price increase takes effect for existing subscribers. Current pricing is always available at 1-0.dev/pricing.

13. Account Suspension and Termination

We may suspend or terminate your access to the Services, in whole or in part, at any time and for any reason, including:

• Violation of these Terms or our acceptable use provisions
• Non-payment of fees after reasonable notice
• Conduct that we reasonably believe is harmful to other users, third parties, or us
• As required by law or legal process

Upon termination, your right to use the Services ceases immediately. We will retain your data for 30 days after termination to allow you to request an export, after which it will be deleted in accordance with our Privacy Policy.

You may terminate your account at any time by contacting us or using the account deletion feature in the FONE app.

14. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Without limiting the foregoing, we do not warrant that:

• The Services will be uninterrupted, error-free, or free of harmful components
• AI-generated responses will be accurate, complete, or appropriate for any particular purpose
• The Services will meet your specific requirements
• Any defects in the Services will be corrected
• VoIP call quality will be consistent (it depends on your internet connection and network conditions)

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ONE DASH ZERO LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, REGARDLESS OF THE THEORY OF LIABILITY.

Our total aggregate liability for any claims arising from or related to your use of the Services shall not exceed the amounts you paid to us in the three (3) months immediately preceding the event giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

16. Indemnification

You agree to indemnify, defend, and hold harmless One Dash Zero LLC, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

• Your use of the Services
• Your violation of these Terms
• Your violation of any applicable law or regulation
• Your content or data provided to the Services
• Any claim that your use of the Services infringes or violates a third party’s rights
• Your failure to comply with call recording consent laws or other telecommunications regulations

17. Dispute Resolution

These Terms are governed by the laws of the State of Wyoming, without regard to conflict of law principles.

Informal resolution: Before filing any formal legal action, you agree to contact us at dash@1-0.dev and attempt to resolve the dispute informally for at least 30 days.

Jurisdiction: Any disputes that cannot be resolved informally shall be resolved exclusively in the state or federal courts located in Sheridan County, Wyoming. You consent to the personal jurisdiction of such courts.

18. Open-Source and Third-Party Software

The Services may incorporate open-source software and third-party libraries. Use of such components is subject to their respective license terms. A list of material open-source components used in the FONE app is available upon request.

19. Export Compliance

You agree to comply with all applicable export control laws and regulations. You may not use the Services in any country subject to a U.S. Government embargo or in violation of any applicable export laws.

20. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

21. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and One Dash Zero LLC regarding the Services. These Terms supersede any prior agreements or understandings, whether written or oral.

22. Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of all or substantially all of our assets.

23. Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. A waiver of any provision shall only be effective if made in writing and signed by an authorized representative of One Dash Zero LLC.

24. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website with a new effective date and, where practicable, by sending notice to the email address associated with your account. Your continued use of the Services after the updated Terms take effect constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Services.
